In the event of any discrepancy, the Dutch version of these Terms & Conditions shall prevail.
Article 1 – Definitions
For the purposes of these Terms & Conditions, the following definitions apply:
Studio: Ellen van Woerden Ceramics.
Participant: any individual who registers for a course, workshop, open studio session or other activity.
Activity: any course, workshop, masterclass, event, workspace rental or other service offered by the Studio.
Article 2 – Applicability
These Terms & Conditions apply to all offers, agreements and activities of the Studio.
By registering for an activity, the Participant agrees to these Terms & Conditions.
Any deviations from these Terms & Conditions are valid only if agreed in writing.
Article 3 – Registration and Payment
A registration becomes final once confirmation has been received from the Studio.
Payment must be made within the payment period stated on the invoice.
If payment is not received, the Studio reserves the right to offer the Participant’s place to someone else.
All prices stated include VAT unless otherwise indicated.
Article 4 – Cancellation of Workshops and Weekend Courses
If a Participant cancels up to 28 days before the start of the activity, the amount paid will be refunded, minus a €25 administration fee.
If a Participant cancels between 28 and 14 days before the start of the activity, 50% of the amount paid will be refunded.
If a Participant cancels within 14 days before the start of the activity, no refund will be given.
The Participant may transfer their place to another person, provided that the Studio is notified in writing in advance.
Article 5 – Cancellation of Regular Courses
Registration for a regular course is final once it has been confirmed.
Cancellation or early termination of a course by the Participant does not entitle the Participant to a refund of the course fee.

Article 6 – Cancellation by the Studio
The Studio reserves the right to cancel or reschedule an activity due to insufficient enrolment, illness of an instructor or other unforeseen circumstances.
In such cases, the Participant will be offered an alternative or will receive a refund of the amount already paid.
The Studio is not liable for any travel or accommodation expenses incurred by Participants.
Article 7 – Missed Classes
If a Participant misses a class, the class may be made up during another regular class, provided that space is available and this has been agreed with the Studio in advance.
Missed classes may also be made up by extending participation in the course by one week, in consultation with the Studio.
Missed classes do not entitle the Participant to a refund of the course fee.
If an instructor is unable to teach a class, the Studio will arrange a substitute instructor or an alternative class date.
Article 8 – Materials and Firing Costs
Unless otherwise stated, clay, glazes and firing costs are included in the course fee.
Additional charges may apply to large pieces, special types of clay or special glazes.
Any additional costs will be discussed with the Participant in advance.
Article 9 – Ceramic Processes and Risk of Damage
Ceramics is a craft process in which cracking, warping, glaze variations or breakage may occur.
Although the Studio handles all pieces with care, damage may occur during drying, transportation, bisque firing, glaze firing or storage.
The Studio accepts no liability for loss, breakage or other damage to ceramic pieces.
No financial compensation will be provided for damaged or lost pieces.
Article 10 – Open Studio
Use of the open studio is permitted only during the reserved times.
Participants work independently and are responsible for leaving their workspace clean and tidy.
The Studio reserves the right to refuse or terminate participation in the open studio if safety rules or studio rules are not followed.
Article 11 – Storage and Collection of Ceramic Pieces
Completed pieces must be collected within three months after the Participant has been notified that they are ready.
Pieces that do not have a name or identifying mark cannot be identified by the Studio. The Studio is not liable for the loss or accidental exchange of such pieces.
Pieces that have not been collected after six months may be disposed of by the Studio without any right to compensation.
The Studio is not responsible for damage to completed pieces that remain in storage for an extended period after the Participant has been notified that they are ready for collection.
Article 12 – Safety
Participants must follow the instructions of instructors and Studio staff.
Equipment and tools are used at the Participant’s own risk.
The Studio reserves the right to deny access to Participants who endanger their own safety or the safety of others.
Article 13 – Liability
Participation in activities is at the Participant’s own risk.
The Studio is not liable for loss, theft or damage to personal belongings.
Any liability of the Studio is limited to the amount paid for the activity concerned.
The Studio is not liable for indirect or consequential loss or damage, including loss of income.
Article 14 – Photography and Video
Photographs and videos may be taken during activities for use on the Studio’s website, social media channels and other promotional materials.
Participants who do not wish to be photographed or filmed must inform the Studio in advance.
Article 15 – Privacy
The Studio processes personal data solely for administrative purposes, communication and the organisation and delivery of activities.
Personal data will not be shared with third parties unless required by law.
Participants may request access to the personal data held about them.
Article 16 – Complaints
Complaints should be submitted in writing as soon as possible.
The Studio will make reasonable efforts to resolve complaints within a reasonable period of time.
Article 17 – Governing Law
All agreements and activities of the Studio are governed by Dutch law.
Any disputes will be submitted to the competent court in the judicial district in which the Studio is established.
